Terms of Sale

These Terms and Conditions of Sale (the "Terms of Sale") are a legal contract between the customer (“you”) and Paul Fredrick Menstyle LLC, ( “Paul Fredrick”, “us” or “we”), and apply to purchases of Products from the https://www.paulfredrick.com website (the “Site”).  Purchases of Products using the Site are also subject to the Paul Fredrick Website Terms of Use (“Website Terms of Use”) which is available here (https://www.paulfredrick.com/pages/website-terms-of-use) and incorporated herein by reference.  Unless otherwise defined in these Terms of Sale, capitalized terms used herein have the meanings provided in the Website Terms of Use.  In the event of a conflict between these Terms of Sale and the Website Terms of Use, these Terms of Sale will control, but only to the extent of the conflict.  By making a purchase with Paul Fredrick, you acknowledge that you have read, understand, and agree to these Terms of Sale and the Website Terms of Use.  If you do not agree to these Terms of Sale and the Website Terms of Use, you are not permitted to purchase Products from the Site. 

Please note, we may change these Terms of Sale at any time, and it is up to you to review and agree to these Terms of Sale and related terms and policies each time before ordering products in case there are any changes. 

Additional terms (“Additional Terms”) may apply to particular products or delivery or return options, which will be presented as part of the order process or provided or made available, to you, including by posting on the Site. In the event of a conflict between these Terms of Sale and applicable Additional Terms, the Additional Terms shall govern. 

 

ORDERING 

PLACING YOUR ORDER

An order is placed by clicking on the "Add to Bag" button, proceeding to the checkout page and providing all required information (correct name and address, phone number, email address, payment details, valid delivery address, and other required information). You should carefully review the Order summary to ensure all information provided is correct and correct any errors prior to submitting the Order. Please review your shopping cart carefully before placing your order. Your shopping cart will may indicate that some of the items you have selected are on backorder and may be delayed. You will have the opportunity to remove any backordered items from your shopping cart before placing your order. Please note that once you have placed your order and affirmatively accepted these Terms of Sale, any in-stock items will begin processing and you will not have the right to cancel in-stock items. However, you may return any item in accordance with our Return Policy (https://www.paulfredrick.com/pages/return-policy). Backordered items may still be cancelled in accordance with our policy Cancellation of Backordered Merchandise (https://www.paulfredrick.com/pages/terms-conditions#backordered-merchandise). 

 

PRICES 

The price that is payable for a Product will be the price in effect at the time the order is placed and will be set out in, if applicable, the confirmation email (described below). Subject to applicable law and as further described below, we have the right to correct or reject offers to purchase if we discover a pricing error. Unless otherwise specified, the product prices are displayed in U.S. dollars and do not include any taxes, shipping and/or handling charges that you may incur at the time of purchase. 

All prices displayed on the Site are excluding the costs for delivery, which will be listed separately during the finalization of the order. 

All prices are subject to change without notice. 

 

PAYMENT 

Payment Options – We accept Visa, Mastercard, American Express, Discover, Paul Fredrick gift cards, Shop Pay, Meta Pay, GPay and Paypal. If you wish to pay by check, you can contact Paul Fredrick Customer Service at customerservice@paulfredrick.com to place your order.  Redemption and use of Paul Fredrick gift cards to purchase products is subject to our Gift Card Terms and Conditions which can be viewed here.  If you attempt to pay using a payment method not specifically authorized by Paul Fredrik, we may reject such payment.  However, if we accept such unauthorized payment method, Paul Fredrick will not be liable for any loss of the payment or any other damages that may result from such action. 

 

PAYMENT CAPTURE 

The payment method you have chosen may be charged in full when you place your order, complete the final checkout, and thereby accept these Terms of Sale. Payment capture will consist of all items on your order, including any backordered items, in-stock merchandise, gift cards, services, gift wrap, sales tax and shipping charges, if applicable.

By submitting an order, you represent and warrant that you are authorized to use the designated payment method that you provide, and you authorize us to charge that payment method for the purchase amount of your order (including any taxes, shipping, handling, and other amounts required). When you provide your payment information, you authorize us (or a third-party service provider working on our behalf) to process and store your payment and other related information. In the event that the credit card or other payment method you selected cannot be verified, is invalid, or otherwise cannot be accepted or confirmed, we may suspend or cancel your order. You are responsible for resolving any problem we encounter in order to proceed with your order. You acknowledge and agree that Paul Fredrick may, if necessary, provide information about you and/or your payment method to governmental authorities, our third party fraud prevention vendors, or other appropriate bodies for the purpose of the prevention of fraud or the notification of fraudulent or other illegal activities. 

 

SALES TAX 

Paul Fredrick is required to collect sales tax where applicable on certain merchandise, shipping and services (i.e. monogramming, alterations and gift wrapping). In the rare event there is an outage of our sales tax system, an estimate of sales tax may be included in your order. Once your order ships, the required sales tax will be recalculated and added to your original order. 

In the event that no sales tax is collected on your order, you are advised to consult your tax advisor or your state's online website to determine whether you are required to remit use tax to your state. 

If you are exempt from the collection of sales tax, please contact us prior to ordering. We will require a valid exemption certificate before completing your order. 

 

NO PURCHASES FOR RESALE 

The products sold on the Site are provided solely for the personal use and benefit of end user consumers and any purchase of product for resale is strictly prohibited.  By placing your order, you agree that you are purchasing products for personal use only and not for resale. Accordingly, if Paul Fredrick determines or has reason to believe, in its sole discretion, that you have made a purchase or order with the intent of reselling the same, in whole or in part, to others (such as to other consumers, businesses, or any other third party), Paul Fredrick reserves the right, in its sole discretion, and as it relates to such purchase or order to: (1) suspend the application of any Paul Fredrick policy that provides a right or benefit intended for direct-to-consumer purchases, as such may relate or pertain to you; and (2) take any action necessary to hinder such purchase or order (and deter future purchases or orders), including without limitation, to restrict sales to you or any consumer account or member account, email or order, associated with you, cancel orders, charge restocking fees, impose purchase quantity limits, decline to issue refunds or take returns, deny access to the Site and/or suspend or close any account, as such may relate or pertain to you. 

 

PRODUCT SPECIFICATIONS; PRICING; TYPOGRAPHICAL ERRORS; DISCOUNTS 

We strive to accurately describe our Products on the Site; however, we do not warrant that such specifications, pricing, or other content on the Site is complete, accurate, reliable, consistent, current, or error-free. In the event of a good faith error, whether on the Site, in an order confirmation, in processing an order, when delivering a product, or otherwise, we reserve the right to contact you to correct such error and provide you with the option of revising your order accordingly (including adjusting and charging the correct price or adjusting a shipping timeline) or cancelling the order and receiving a refund of any amount charged, as permitted by applicable law. Your orders are offers to purchase subject to our acceptance, which we may reject or cancel, subject to refund (if applicable). If we charged your credit or other account prior to rejection or cancellation, we will reissue credit to your account.  

Paul Fredrick may from time to time offer discounts, discount programs, or loyalty programs, any of which may also be changed or revoked at any time. Discount programs are intended for personal use only and you may not share discounts with third parties or make purchases for anyone other than immediate family members, unless the terms of the discount program state otherwise. Discount programs may not be applicable to specific products or to sale items and cannot be combined with any other offers. Discount and loyalty programs offered by Paul Fredrick may have Additional Terms and conditions that apply. Unless otherwise provided for in a separate discount or loyalty program agreement: (a) we may restrict the types of acceptable payment used in connection with an applicable discount, for example, a debit or credit card may be required; and (b) you may not resell any product purchased with your applied discount. You acknowledge and agree that we have the absolute right to deny use of an applicable discount or refuse orders to any person suspected of reselling or orders which have characteristics of reselling. 

 

ORDER STATUS 

You may check the status of your order(s) by my using the “My Account” or “Order History” links on our website. 

 

AFTER YOUR ORDER PLACEMENT 

CONFIRMATION NOTICE 

Upon placing your order, you should receive an email confirmation to the email address you provided during the check out process. The confirmation email will list a description of the items you ordered, and their applicable prices. There may be situations where some of your merchandise has been backordered. A placed and confirmed order does not bind Paul Fredrick, but instead constitutes an offer of the customer to purchase the relevant Product(s) in consideration for payment of the applicable prices. All orders must then be formally accepted by Paul Fredrick, which takes place when the Products are shipped to you. Paul Fredrick reserves the right, in its sole and exclusive discretion, to refuse or cancel any order(s), for any reason, as permitted by applicable law, including such order(s) that Paul Fredrick suspects were not placed in good faith or were not placed by individuals. If a suspicion arises that your identity, address, email address and/or payment information has been used fraudulently or in an unauthorized manner, you may be required to provide additional verifications and information before, and as a condition to, the acceptance of any order.   

 

FOLLOW UP NOTICES 

We will use commercially reasonable efforts to notify you via email when an item you ordered is being shipped. Please see our Shipping Information (https://www.paulfredrick.com/pages/shipping-information) page for more information. 

ORDERS IN STOCK 

We anticipate that all merchandise in stock at the time you place your order will be shipped per the estimated dates found on our Shipping Information page. We will use commercially reasonable efforts to send you an email notifying you when the in-stock items have shipped. You acknowledge and agree that our ability to sell and fulfill orders is subject to: (a) item availability; and (b) our sole discretion in managing inventory. Paul Fredrick is not obligated to accept any order and expressly reserves the right to limit, decline or reject any sale or order for any or no reason, without explanation and without being liable to you for any damages or costs other than repayment of any amount or amounts that Paul Fredrick had previously received from you with regards to such sale or order. 

 

BACKORDERED MERCHANDISE 

We will send you an email when a backordered item has been processed for shipment. Please note that the arrival of backordered merchandise is outside of our control, and estimated dates may change, but we will endeavor to keep you apprised every step of the way. You can always check your order status at any time during this process by contacting Paul Fredrick customer service. Our email updates are deemed sufficient notice to you of the status of your backordered items and our right to retain your payment during the processing, shipping, and delivery periods. Our notice is deemed given when we send the notice to your last known email address according to our records. Our notices do not require an affirmative response from you to be deemed given, but you may contact us about your order at any time for updates or to initiate a refund per our Refund Policy below. We may cancel certain delayed backordered items, in which event we will promptly notify you by email at your last known email address according to our records. PRICE ADJUSTMENT POLICIES 

If an item you purchased from Paul Fredrick goes on sale for a lower price within 14 days of the date of original purchase, we will refund the difference upon request.

CANCELLATION of BACKORDERED MERCHANDISE 

We reserve the right to cancel one or more backordered items in your order if we reasonably determine, in our sole discretion, that the backordered item will be delayed for an extensive period. If we cancel any of your backordered items, we will promptly notify you at your last known email address in our records. This notification will include when to expect your refund (if any). 

Customers may cancel a backorder at any time for store credit or refund by contacting customer service at customerservice@paulfredrick.com or call 1-800-247-1417. 

 

DELIVERY

Additional Terms may apply.  You acknowledge that any estimated delivery dates that we provide are non-binding estimates only and you have no claim against Paul Fredrick for delays or early deliveries.  Paul Fredrick may provide discounted or no cost standard shipping on orders that exceed certain dollar amount order thresholds, as such may be determined in our sole discretion and from time to time. 

Your order will be delivered to the delivery address that you provided to us at the time you placed your order. We cannot accommodate multiple delivery addresses on a single order therefore all products within the same order must ship to the same delivery address. It is our preference to deliver all items from a single order within a single shipment however, due to numerous factors, this may not always be possible and, accordingly, products in a single order may be delivered in split shipments. We reserve the right, at its sole discretion, to split the delivery of any order into two or more shipments.  Upon delivery, it is your duty to inspect the packaging and products for damage. If it appears that the products are damaged, please do not accept the shipment, and contact our customer support for assistance. 

If we discover that we can no longer deliver the ordered products, we will be entitled to cancel the order. We will promptly notify you of any such cancellation by email to your last known email address according to our records and will refund any applicable amounts paid for such cancelled order. 

Title and risk of loss for fully paid for Products purchased from Paul Fredrick passes to you upon our delivery of the product(s) to a common carrier (e.g., UPS, FedEx, USPS). As a result, we shall have no responsibility for the Product once it is delivered to the carrier and you are responsible for filing any claims with carriers for damaged and/or lost shipments.  Title to Product(s) will not transfer until full payment has been received by Paul Fredrick. 

Applicable duties, taxes and handling fees for international orders are not included in our prices. These charges are the customer's responsibility and must be paid by the customer to the delivering agent upon delivery. All pricing is in U.S. funds. 

 

DISCLAIMER OF WARRANTIES 

TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, EXCEPT AS EXPRESSLY PROVIDED BY PAUL FREDRICK IN WRITING, THE PRODUCTS ARE PROVIDED ON AN “AS-IS” BASIS, WITHOUT WARRANTIES OF ANY KIND.  PAUL FREDRICK DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, FOR ANY PRODUCT. THE FOREGOING DISCLAIMER OF WARRANTY, HOWEVER, DOES NOT APPLY TO ANY PRODUCT OR MANUFACTURER WARRANTY EXPRESSLY OFFERED BY PAUL FREDRICK AND/OR ANY THIRD-PARTY MANUFACTURER OF MERCHANDISE.  SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. 

LIMITATION OF LIABILITY. 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER PAUL FREDRICK NOR ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS OR SPONSORS ARE RESPONSIBLE OR LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS OR INJURY OR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE OR OTHER DAMAGES UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY ARISING OUT OF OR RELATING IN ANY WAY TO (i) THE USE OF OR INABILITY TO USE THE SITE OR MATERIALS; (ii) ANY CONTENT CONTAINED ON OR ACCESSED THROUGH THE SITE; (iii) STATEMENTS OR CONDUCT POSTED OR MADE PUBLICLY AVAILABLE ON THE SITE; (iv) ANY PRODUCT PURCHASED OR OBTAINED THROUGH THE SITE; (v) ANY ACTION TAKEN IN RESPONSE TO OR AS A RESULT OF ANY INFORMATION AVAILABLE ON THE SITE OR IN THE MATERIALS; (vi) ANY DAMAGE CAUSED BY LOSS OF ACCESS TO, DELETION OF, FAILURE TO STORE, FAILURE TO BACK UP, OR ALTERATION OF ANY CONTENT OR MATERIALS ON OR ACCESSIBLE THROUGH THE SITE, OR (vii) ANY OTHER MATTER RELATING TO THE SITE. IN NO EVENT SHALL PAUL FREDRICK’S TOTAL LIABILITY TO YOU FOR ANY AND ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, STATUTORY, OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR USING THE SITE AND/OR FOR THE PRODUCT(S) PURCHASED IN THE RELEVANT TRANSACTION. 

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS AND DISCLAIMERS MAY NOT APPLY TO YOU.  IF ANY PART OF THE DISCLAIMERS OF WARRANTY OR THIS LIMITATION OF LIABILITY IS DETERMINED TO BE UNENFORCEABLE OR INVALID FOR ANY REASON, YOU AGREE THAT PAUL FREDRICK’S LIABILITY TO YOU FOR ANY DAMAGE OR LOSS SHALL BE LIMITED TO THE FULLEST EXTENT ENFORCEABLE BY APPLICABLE LAW. 

 

International Customers 

  • Pre-paid labels are not available for customers outside of the United States. 

  • Items should be shipped back to Paul Fredrick, using the "Carrier of your choice" instructions above. 

  • Return shipping charges are not refundable.
