We collect information that identifies, describes, or can reasonably be associated with you (“Personal Information”). Personal Information does not include publicly available information in government records or any data that has been deidentified or aggregated. If you purchase or return any Paul Fredrick clothes or products, we collect the following Personal Information: 

  • Personal identifiers. This includes your name, phone number, unique or online identifier, email address, and mailing address; 

  • Commercial information. This includes your order history; and, 

  • Financial information. Our payment processors collect payment information such as credit card information and applicable shipping and billing address. 

We use this information to complete your purchase, to communicate with you, to provide you information about exclusive offers and products based on your past purchases and items considered. 

  • Signing Up for an Account 

If you create an account, we collect the following Personal Information: 

  • Personal identifiers. This includes your name, phone number, email address, and mailing address; 

  • Account information. This includes your name, email address, phone number, associated addresses, items purchased, returned or exchanged, and account and email preferences; 

  • Commercial information. This includes your order history or any items you may have added to your wishlist and saved; and, 

  • Financial information. Our payment processors collect payment information such as credit card information and applicable shipping and billing address. 

We use this information to support your account, to communicate with you, to provide you information about exclusive offers and products based on your past purchases, items considered, and items saved. 

  • Requesting Our Catalogs 

If you sign up to receive our catalogs, we collect your name, email, phone number, and mailing address to deliver the catalogs to you. 

  • Contacting Customer Service 

If you contact customer service for questions, comments, or feedback, we collect the following Personal Information: 

  • Personal identifiers. This includes your name and contact information, which may be your email address and/or phone number depending on whether you contact us online or over the phone; 

  • Commercial information. This includes your order history if you made a purchase; 

  • Audio or video recording. We collect this if you call us or send video content; and, 

  • Other information you provide. We collect your comments and other details about your request for customer support. 

We use this information to respond to your request for customer support. We take your comments and feedback seriously, so we may also learn from this information to improve our quality assurance and for training purposes. 

  • Visiting Our Site 

  • If you visit our Site, we use cookies, tags, pixels, and similar tracking technologies (“Cookies”) to support, customize, evaluate, improve, and secure our Site. We also use Cookies to understand which items, offers, and products may be interesting to you. These Cookies automatically collect information when you visit the Site, including IP address, general location information, domain name, page views, a date/time stamp, browser type, device type, device ID, Internet service provider, referring and exiting URLs, operating system, language, clickstream data, and similar device and usage information. 

  • We use Cookies to help us run our Site securely and enable basic functions like page loading or navigation. Some Cookies help us analyze how you interact with our Site, including which items you may view or consider.   • Joining Our Mailing List 

If you subscribe to our mailing list, we collect your email address to send you information about products or promotional opportunities that may interest you. We may also collect your email address, and you may be added to our mailing list if your friend sends you their wishlist from our Site. You can unsubscribe by clicking the “Unsubscribe” button at the bottom of any Paul Fredrick email or by visiting the “Unsubscribe” page Here (www.paulfredrick.com/pages/unsubscribe-page). You may also change your email preferences in your account 

  • Creating an Account and Joining our Loyalty Program 

If you create an account with us, you will be enrolled in our loyalty program, the PF Style Club. We may collect name, email address, mailing address, purchase history, information about your use of the program, and account preferences, to set up, operate, and administer your PF Style Club account and to track your transactions in order to administer the program. Additionally, PF Style Club members may refer new customers to join the program to receive a discount on qualifying purchases. If you have been referred to the PF Style Club by another PF Style Club member, we may collect your email address to send you information about the program.

  • Interacting with Us on Social Media  

If you follow or friend us on any social networking platforms, such as Twitter, Facebook, Instagram, and Pinterest, both Paul Fredrick and/or the social media platform may collect Personal Information about you, including: 

  • Personal identifiers. This includes the username or handle you use for that social media platform; 

  • Content you post. We may collect content you share or post on Paul Fredrick’s pages or threads, including product reviews; and, 

  • Social media contacts. Depending on your privacy settings, we may collect your contacts, followers, or friends on that social media platform. 

We use the information we receive through social media to enhance our social media presence, improve our products and Services, and deliver relevant information about promotional opportunities, marketing materials, or other incentives. We do not control and are not responsible for how social media platforms use the information they may collect about you when you use social media. Instead, you should look to the social media platform’s privacy policy and terms to understand their practices or control your choices. 

How We Disclose Personal Information 

Paul Fredrick works with vendors and service providers to make our Site function, improve our styles and Services, and run our day-to-day operations. 

  • Disclosures to Provide the Services You Request and Support Operations  

  • Service Providers. We rely on vendors, professionals, and technical support providers to help us operate the Site and Services by doing things like designing the Site, processing your payment, shipping your orders, and supporting our email, SMS, chat and call center communications. 

  • Marketing and Advertising Companies. We rely on other vendors to help us place ads, customize them to certain audiences or users, understand whether those ads are successful, and improve our marketing efforts.   • Disclosures With Your Permission or Upon Notice  

  • Disclosures Required or Permitted by Law  

Nothing in this Privacy Policy restricts Paul Fredrick’s ability to:  

  • Prevent, investigate, or provide notice of fraud, unlawful or criminal activity, or unauthorized access to or use of Personal Information, our Site or data systems; 

  • Collect, use, or share aggregate, de-identified data; 

  • Comply with federal, state, or local laws; 

  • Comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, or local authorities; 

  • Cooperate with law enforcement agencies concerning conduct or activity we, our service providers, or other third parties reasonably and in good faith believes may violate federal, state, or local law; 

  • Exercise our rights or defend against legal actions; or, 

  • Transfer Personal Information as part of an actual or proposed organizational transaction, such as a merger or dissolution, or if insolvency occurs, bankruptcy, or receivership. 

How We and Third Parties Use Cookies and Tracking Technologies  

  • Cookies are alphanumeric identifiers that are transferred to your device. Some cookies make it easier for you to navigate our Sites, while others are used to enable a faster log-in process or to allow us and third parties to track your activities on our Sites and other sites as described below. We and third parties, such as ad networks, channel partners, mobile ad networks, analytics and measurement services and others, use cookies and other tracking mechanisms to track your use of our Services to personalize content, to conduct analytics, measurement, heatmapping and session replay, to use data to obtain more information about visitors and reach out to them through other channels, such as email and/or direct mail, and to display advertising within our Services, as well as to manage our advertising on third-party sites, mobile apps and online services, to identify and retarget visitors and to evaluate the success of such ads and content. Through cookies and other tracking technologies, we and third parties may collect the following types of Personal Information: IP address, general location information, hashed versions of email and phone number, domain name, page views, a date/time stamp, browser type, device type, online or unique IDs, Internet service provider, referring and exiting URLs, operating system, language, clickstream data, and similar device and usage information. 

  • Our Sites may include social media features, such as Instagram, Facebook, and Pinterest widgets. These features may collect electronic and other internet activity information, such as your IP address and which page you are visiting. These widgets may set a cookie or utilize other tracking technologies to accomplish this. Social media features and widgets are hosted by a third party and your interactions with those features are governed by the privacy policies of the companies that provide them. 

  • Unless you have opted out, we may share certain hashed customer list information (such as your name, email address and other contact information) with third parties so that we can better target ads and content to our users, and others with similar interests, within third party sites, platforms and services. 

Tracking and Advertising Choices 

If you wish to prevent cookies and other technologies from tracking your activity, there are tools you can use to disable cookies and opt out of interest-based advertising. Note that your opt out may not be effective if your browser is configured to reject cookies. We also give you options to disable marketing communications, exercise any privacy rights you may have and update your account information as described below: 

  • Browser Solutions for Disabling Cookies. If you wish to prevent cookies from tracking your activity on our Site or visits across multiple websites, you can set your browser to block certain cookies or notify you when a cookie is set. The Help portion of the toolbar on most browsers will tell you how to prevent your device from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Visitors to our Services who disable cookies will be able to browse the Site, but some features may not function. 

  • Industry Solutions for Opting Out of Interest-Based Advertising. Notwithstanding the above, you may follow the steps provided by initiatives that educate users on how to set tracking preferences for most online advertising tools. These resources include the Network Advertising Initiative (https://thenai.org/about-online-advertising/) and the Digital Advertising Alliance (https://digitaladvertisingalliance.org/). The Digital Advertising Alliance also offers an application called AppChoices (https://youradchoices.com/appchoices) that helps users to control interest-based advertising on mobile apps. 

  • Marketing Emails. You can unsubscribe from our marketing emails by visiting this link https://www.paulfredrick.com/pages/unsubscribe-page, following the link to unsubscribe at the bottom of any Paul Fredrick email, or you can manage your preferences in your account. 

  • Opt-Out of Direct Mail Marketing. If you would like to stop receiving our advertising materials in the mail, please contact us at 1-800-247-1417 or customerservice@paulfredrick.com to opt out and stop receiving direct mail. 

  • Analytics. You can also download the Google Analytics Opt out Browser Add-on to prevent data from being used by Google Analytics at https://tools.google.com/dlpage/gaoptout. You will need to do this for each browser on each device. 

  • Session Replay: We also use Mouseflow to understand how you interact with our Site through heatmapping and session replay technology, which you can also disable at https://mouseflow.com/opt-out/ or by following the directions in the Cookie Preference Center on the Site. 

  • SMS Privacy Policy: Paul Fredrick uses cookies to collect information around abandoned shopping carts. A cart is considered abandoned within one hour of inactivity/lack of purchase. Once the cart is considered abandoned, an SMS message will be sent as a reminder. You can text STOP to opt out of these messages. 

California Privacy Policy & Notice Collection  

Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act of 2020 (“CCPA”), California residents have the right to receive certain disclosures regarding our information practices related to “Personal Information,” as defined under the CCPA. To the extent you are a resident of California, and we collect Personal Information subject to CCPA, the following applies.

  • Categories of Personal Information Collected
  • Identifiers such as name, address, unique or online identifier, IP address, e-mail address, account name, or other similar identifiers.
  • Customer records such as address, phone number, and financial or payment information.
  • Commercial information such as records of products or services purchased, obtained, or considered, or other purchasing or use histories or tendencies.
  • Internet or other electronic network activity information such as browsing history, search history, and information regarding an individual’s interaction with an internet website, application, or advertisement.
  • Geolocation data such as general location information about a particular individual or device.
  • Audio, Electronic, Visual, or Similar Information such as audio call recordings (e.g., of customer support calls) or videos.
  • Inferences such as inferences drawn from any of the information identified above to create a profile reflecting a consumer’s preferences, characteristics, behavior, or attitudes.
  • Purposes for Collecting and Disclosing Personal Information

As further described in the Personal Information We Collect and How We Use It section above, we may collect and process the above listed Personal Information for the following business or commercial purposes and as otherwise directed or consented to by you: to operate our business; complete your purchases; manage your account; manage our loyalty program; marketing and promotions; communications; customer service; customization and personalization; research and development; audits and assessments; analytics and improvement; business transfers; security and protection of rights; compliance and legal process; auditing, reporting, and other internal operations; and general business and operational purposes.

  • Sources of Personal Information

As further described in the Personal Information We Collect and How We Use It section above, we collect Personal Information from the following sources: directly from you; advertising networks; third party analytics providers; social networks; internet service providers; operating systems and platforms; your friends; affiliated entities; partners (e.g., if we offer a joint promotion); and regulators, government entities and law enforcement.

  • Disclosures to Third Parties for a Business or Commercial Purpose

This section relates to our third-party disclosures. In addition to disclosing Personal Information to service providers for business purposes such as hosting providers, we may also disclose the Personal Information we collect including online identifiers and contact information (as described in the How We and Third Parties Use Cookies and Tracking Technologies section above) to the following categories of third parties: third party analytics providers, advertisers, social networks, internet service providers; operating systems and platforms; your friends; affiliated entities; partners (e.g., if we offer a joint promotion); and regulators, government entities, and law enforcement.

  • Sales and Sharing of Personal Information

CCPA defines a "sale" as disclosing or making available to a third-party Personal Information in exchange for monetary or other valuable consideration, and “sharing” broadly includes disclosing or making available Personal Information to a third party for cross-context behavioral advertising purposes. While we do not disclose Personal Information to third parties in exchange for monetary compensation, we may “sell” or “share” (as defined by the CCPA) online identifiers, hashed phone

and email, preferences and internet and electronic network activity information to third-party analytics and ad providers and social networks; internet service providers; operating systems and platforms; affiliated entities; and partners (e.g., if we offer a joint promotion). We do so in order to improve and evaluate our advertising campaigns and better reach customers and prospective customers with more relevant ads and content.

We do not have actual knowledge that we sell any Personal Information about individuals that are under sixteen (16) years old.

You may opt out of the “sale” or “sharing” of your Personal Information to third parties through cookies on our site by clicking the cookie settings link in the footer, toggling the “opt out” button to the left, and clicking “Confirm My Choices.”

We honor your right to opt out as signaled by a universal opt out signal or Global Privacy Control (“GPC”). To enable GPC, you can visit the Global Privacy Control page at https://globalprivacycontrol.org. If you download a supported browser or extension and exercise your privacy rights with GPC, we will turn off third-party advertising cookies on our Site once our Site detects a GPC signal. If you visit our site from a different device or from a different browser on the same device, you will need to opt out again or use an opt out preference signal for that browser and/or device.

  • Sensitive Personal Information

We do not collect, use, or disclose “sensitive personal information” beyond the purposes authorized by the CCPA.

  • California Privacy Rights

To the extent you are a resident of California, you may have the following rights to your Personal Information:

  • Right to Access. With respect to the Personal Information we have collected about you, you have the right to request from us: (i) categories of Personal Information about you we have collected; (ii) the sources from which we have collected that Personal Information; (iii) our business or commercial purposes for collecting, selling, or disclosing that Personal Information; (iv) the categories of third parties to whom we have disclosed that Personal Information; and (v) a copy of the specific pieces of your Personal Information we have collected.
  • Right to Correct. You have the right to request that we correct inaccuracies in your Personal Information.
  • Right to Delete. Subject to certain conditions and exceptions, you may have the right to request deletion of your Personal Information.
  • Right to Opt-out of Sales and Sharing. You have the right to opt of out “sales” and “sharing” as defined by the CCPA. To exercise this right, follow the directions in the Sales and Sharing of Personal Information section above.
  • Right to Limit Use and Disclosure of Sensitive Personal Information. We do not engage in uses or disclosures of Personal Information that would trigger the right to limit use and disclosure of sensitive personal information under the CCPA.
  • Right to Non-Discrimination. We will not discriminate against you for exercising any of the rights described in this section.

For all requests, please clearly state that the request is related to “Your California Privacy Rights” and provide your name, street address, city, state, zip code and an e-mail address or phone number where you may be contacted. We will take steps to verify your request by matching the information provided by you with the information we have in our records. In some cases, we may request additional information in order to verify your request or, where necessary, to process your request. If we are unable to adequately verify your request, we will notify you.

  • Verification

Before we can respond to your request, we must verify your identity using Personal Information. If we cannot verify your request, we will contact you for more information. If we cannot verify your identity after a good faith attempt, we may deny the request and, if so, will explain the basis for the denial.

  • Designating an Authorized Agent

You may designate someone to submit requests and act on your behalf (an “Authorized Agent”). To do so, you must provide us with written permission to allow your Authorized Agent to act on your behalf.

  • Retention

We retain the Personal Information we collect only as reasonably necessary for the purposes described above or otherwise disclosed to you at the time of collection. For example, we will retain your profile and account data for as long as you have an active account with us, as well as an additional period of time as necessary to protect, defend or establish our rights, defend against potential claims, and comply with legal obligations.

Notice of Financial Incentives

We may make available certain programs or offerings that may be considered “financial incentives” under the California Consumer Privacy Act (“CCPA”) or “bona fide loyalty programs” under the Colorado Privacy Act (“CPA”) (“Programs”).

Supplemental Privacy Notice for Residents of Certain States

Residents of certain U.S. states including, Colorado, Connecticut, Delaware, Nebraska, New Jersey, Texas, and Virginia, are provided additional disclosures under applicable privacy laws.

  • Sale and Processing Personal Information for Targeted Advertising. While we do not disclose personal information to third parties in exchange for monetary compensation, we may “sell” or process personal information for targeted advertising. To opt out, you can adjust your cookies settings here or on your device. In Colorado, Connecticut, Delaware, Nebraska, New Jersey, and Texas, our Site will also respond to global privacy control—or “GPC”—signals, which means that if we detect that your browser is communicating a GPC signal, we will process that as a request to opt that particular browser and device out of sales and targeted advertising (i.e., via cookies and certain tracking tools) on our Site.   • Right to Appeal. If we deny your request, you may appeal our decision by contacting us below or following the instructions in our appeals’ communication.

We will respond to your request as required by law. When you submit a request, we will take steps to verify your identity and request by matching the information provided by you with the information we have in our records. In some cases, we may request additional information in order to verify your identity, or where necessary to process your request. If we are unable to verify your identity after a good faith attempt, we may deny the request. If your request is denied, we will explain the basis for the denial.

To the extent required under applicable U.S. privacy laws, you may also designate someone as an authorized agent to submit requests and act on your behalf. Authorized agents may be required to provide proof of their authorization, and we may also require the relevant consumer to directly verify the identity and authority of the authorized agent.

Third-Party Sites and Links

Our Site may contain links to other websites. A link to a third party’s website does not mean we endorse it or that we are affiliated with it. We do not exercise control over third-party websites, so we are not responsible for how they treat your Personal Information. Always read the privacy policy of a third-party website before providing any information to the website.

Children’s Privacy

The Site is not intended for children. We do not knowingly collect Personal Information from children. If we learn we have inadvertently received Personal Information from a child, we will delete such information from our records.
